CDOT Design-Build Regulations

The purpose is to implement the provisions of Part 14 of Article 1 of Title 43, C.R.S., by establishing procedures and requirements for CDOT to procure Design-Build Contracts for Transportation Projects.

Federal Design-Build Regulations

This describes the FHWA’s policies and procedures for approving design-build projects financed under title 23, United States Code (U.S.C.). This part satisfies the requirement of section 1307(c) of the Transportation Equity Act for the 21st Century (TEA–21), enacted on June 9, 1998. The contracting procedures of this part apply to all design-build project funded under title 23, U.S.C.

Design-Build Project Team Confidentiality and Non-Disclosure Agreement

All members of the CDOT team that participate in the development of the procurement and contract documents and the procurement process should sign the Confidentiality and Non-Disclosure Agreement.

Non-Conflict of Interest/Confidentiality Statement

All members of the evaluation teams for the Statements of Qualifications and the Proposals should sign the Non-Conflict of Interest/Confidentiality Statement.

Request for Qualifications

CDOT uses a two-phase value based procurement process to select a Design-Build contractor to deliver the Project. This Request for Qualifications (RFQ) is issued as part of the first phase.

FHWA Stewardship and Oversight Agreement

Section 5.4.2 of the Design-Build Manual discusses the FHWA Processes for Design-Build. CDOT and FHWA have jointly developed a Stewardship and Oversight Agreement which is sometimes supplemented by a project specific Oversight Roles and Responsibilities document on Design-Build projects.
