CDOT Rules

This page is designed to give you information about rules within the jurisdiction of the Colorado Department of Transportation and the Transportation Commission. The online versions of these regulations, available officially from the Colorado Secretary of State, are the most current versions available. 

CDOT annually publishes a proposed Departmental Regulatory Agenda pursuant to § 2-7-203(4), C.R.S., which will include all new rules, amendments to existing rules or repealed rules that CDOT foresees in the upcoming year. The calendar listed for each set of rules is subject to change.

Proposed Rules & Public Hearing Dates

The following rules are in the process of being revised by CDOT staff and set for a public rulemaking hearing. Proposed revisions are required by statute to be available five days prior to the hearing date. Please check this page five days prior to the hearing for the final proposed rule that will be discussed at the hearing.

Stakeholder Engagement Protocol & Workshop Dates

Background

Where the General Assembly provides authority to CDOT to promulgate administrative rules, CDOT establishes a representative group of participants with an interest in the subject of the rules. This group is established early on before the formal rule-making process commences and submits comments on the proposed revisions under consideration. The overarching goal is to assure interested parties have easy and early notification and opportunity to submit comments or questions for meaningful consideration and discussion on rules and regulations.

How to Become a Department Stakeholder

As stated above, citizens can be involved in both the drafting of proposed rules and the revision of such rules in the preliminary drafting phase and throughout the rule-making process. To sign-up as an interested party, contact Sari Weichbrodt via email at [email protected]  or scroll to the table at the bottom of the web page to sign up for a specific rulemaking.

Petitions for Rulemaking

You also have the right to petition for the issuance, amendment, or repeal of a rule. This provides you the opportunity to identify problematic rules and to help us improve efficiency. The “Petition for Rulemaking” must be submitted directly to Sari Weichbrodt via email at [email protected]  and is open to public inspection. Action on a petition is at our discretion; but when we undertake rulemaking on a matter, all related petitions for the issuance, amendment, or repeal of rules must be considered and acted upon in the same proceeding. 

Final Rules

The rules and regulations adopted and promulgated by CDOT are available on its website, codot.gov/business/rules and on the Secretary of State’s website http://www.sos.state.co.us. The Secretary of State compiles and publishes the administrative rules in the Code of Colorado Regulations. Notices of rule-making, proposed rules, new and amended rules, and Attorney General rules opinions are published twice monthly in the companion publication, the Colorado Register. The official Code and Register are also published on the Secretary of State website.
