I-25 and Santa Fe Drive Disclaimer

The electronic files contained herein are ‘in progress’ files for preparation of construction drawings of the reconstruction of mainline I-25 between Broadway and Alameda. In addition to mainline I-25, the project includes the northbound Santa Fe to northbound I-25 flyover ramp (Ramp 1) to be constructed in its permanent location. Bridges for both mainline I-25 and the Ramp 1 flyover include the Contractor’s option for alternative design subject to the conditions, standards, and guidelines provided in the plans and project specifications.

The other ramps constructed as part of the project will be in an interim condition until such time as a Single Point Urban Interchange (SPUI) is constructed (at an unknown future date). This (interim) project takes into account the final configuration and structure placement has been determined based upon the ultimate SPUI.

It should be noted that the electronic files are not construction documents. Differences may exist between these electronic files and corresponding hard-copy construction documents. No representation is made regarding the accuracy or completeness of the electronic files contained herein. In the event that a conflict arises between the signed or sealed hard-copy construction documents and the electronic files, the signed or sealed hard-copy construction documents shall govern.

The electronic files are provided solely for your convenience and reference. By acknowledging below you hereby agree to the following:

1.    The electronic files are compatible with Version 4.00 CDOT MicroStation XM. We make no representation as to the compatibility of these files, with your hardware or your software, beyond the specified release of the referenced specifications.

2.    Data contained on these electronic files are part of the designers’ instruments of service and shall not be used by you or anyone else receiving these files through or from you for any purpose other than as a convenience in the referencing of planned construction improvements to the I-25 Santa Fe corridor, CDOT Project Number BR 0252-407, Code 17783 also know as Stages 1.2 and 1.3.

3.    Any other use or reuse by you or by others will be at your sole risk and without liability or legal exposure to us. You agree to make no claim and hereby waive, to the fullest extent permitted by law, any claim or cause of action of any nature against CDOT, its design consultants and their officers, directors, employees, agents or subconsultants that may arise out of or in connection with your use of the electronic files.

4.    You shall, to the fullest extent permitted by law, indemnify and hold CDOT and its design consultants harmless against all damages, liabilities or costs, including reasonable attorneys’ fees and defense costs, arising out of or resulting from your use of these electronic files.

5.    You are responsible for determining if any conflict exists. By your use of these electronic files, you are not relieved of your duty to fully comply with the contract documents, including, and without limitation, the need to check, confirm and coordinate all dimensions and details, take field measurements, verify field conditions and coordinate your work with that of other contractors for the above referenced project.

Because information presented on the electronic files can be modified, unintentionally or otherwise, no indicia of ownership and/or involvement from CDOT or its design consultants shall be placed upon electronic displays.

Under no circumstances shall delivery of the electronic files for use by you be deemed a sale by CDOT or its design consultants, and no warranty is made, either express or implied, of merchantability and fitness for any particular purpose. In no event shall CDOT or its design consultants be liable for any loss of profit or any consequential damages as a result of your use or reuse of these electronic files.
